Al-Tahaluf in the light of Fiqa-e-Hanafi: An analytical study of Marju’ Anha Aqwal of Imam Abu Hanifa

Abstract

Islamic jurisprudence (Fiqh), rooted in the Quran and the Sunnah of Prophet Muhammad ﷺ forms the foundation of Islamic law. Imam Abu Hanifa (RA), recognized as the founder of Fiqh, made unparalleled contributions by organizing the dispersed scholarly heritage of the Companions (RA) and their Successors (Tabi'un) into a systematic framework. Assisted by a team of forty jurists, he classified Fiqh into chapters addressing worship, transactions, marriage, and criminal laws, setting a historical precedent in legal scholarship.

This study offers an analytical investigation into the retracted opinions (Marju' Anha Aqwal) of Imam Abu Hanifa (RA) as recorded in Fiqa-e-Hanafi. It examines these opinions across key areas of Islamic law, including worship, marriage, Li'an, criminal laws, and transactions, highlighting the dynamic and adaptive nature of Hanafi jurisprudential approach. The research analyzes Al-Tahaluf (the principle of reconciliation) within the retracted opinions of the Imam (RA), illustrating its relevance in addressing contemporary Fiqh challenges. By delving into the jurisprudential contributions and intellectual insights of Imam Abu Hanifa (RA), this study serves as a valuable resource for understanding his legacy and its application in modern contexts, providing practical guidance for the Muslim Ummah.
